于婷 四川省平昌中学   In recent years, with the increasing development of technology and globalization, our country further deepens international communication and cooperation. Therefore, foreign culture has a great influence on our indigenous culture. Nowadays, there is a hot trend for the youths to watch American TV dramas, which are enormously prevalent among teenagers and the youths. Regarding this phenomenon, various people maintain distinctive standpoints, and some people hold watching American TV dramas can facilitate and enhance their language feeling while others hold the opposite view. However, as for me, I uphold that the disadvantages of watching American TV dramas outweigh its benefits. I will numerate reasonable and solid evidences to substantiate my opinion. To begin with, considering that most youngsters are keen on watching American TV dramas, it will consume too much time and energy so that it postpones people’s work and study. Then, some American TV dramas will have a pessimistic effect on the youngsters’ health of mind and body. The reasons are that they are in the age of puberty so that their mind is not mature and they are destitute of the capability of distinguishing clearly between right and wrong. Therefore, exposure to American TV dramas with violence, vulgar language will impact on their mind and body and behavior, which engenders the youth to form the bad habits. What’s more, one the one hand, some people will subconsciously imitate the plot to pursue stimulation so that they will do some aggressive behaviors to hurt others and themselves. On the other hand, suppose the youths would be wild about their favorite stars, they will blindly chase stars, even imitate their behaviors, which will bring heavy burdens to their family and affect their study. Last but not least, to some extent, watching American TV dramas will invade our traditional and marvelous culture and change the thoughts of the youths. Simultaneously, numerous American TV dramas are swarming into Chinese film and television market, which brings giant impact on Chinese film and television industry, and maybe they will be dominated and replaced by American TV dramas. As mentioned above, I can definitely draw a reasonable conclusion that it is indisputable that watching American TV dramas is bad for the youths on account of those various drawbacks listed. Therefore, I disapprove of the youths’ watching American TV dramas.

  ——《民主与不信任》读书报告（4）  孙婧文 法24 2012012856 导言 二十世纪五六十年代，政治家出身的沃伦法院积极介入政治，以抽象的条款和一般的宪法原则频繁的裁判侵害民权的法案违宪，被认为是司法能动性的典型。在理论上，这种行为受到了很大的质疑。正是在诸多质疑声中，Bickel在其《最小危险部门》中将著名的“反多数主义难题”明确的提了出来，并寻求解决方案。Bickel认为法官更适宜对宪法的价值进行判断，因为法官自身更像是一位学者，更有精力与能力去进行这种价值判断。 然而，Ely并不对Bickel的答案感到满意。 因为这种解释没有解决价值的来源或标准问题，从而不能有效的回答“大法官将自己的价值的标准强加于民众”或其他关于不民主的问题。 因此，Ely带着Bickel的问题意识提出了自己关于程序导向的司法审查方法，从而形成了一个“参与导向的、强化代议制”的司法审查理论。基于这个理论，一方面解决了诸多过于司法能动性判决的正当性问题，另一方面对司法审查的界限制定了适当的要求。 本文将主要围绕着《民主与不信任》的第四章，对Ely的程序性导向的解释方法（司法审查理论）加以总结与梳理，从而进一步提出自己的一些观点与疑问。   一、法院所扮演的角色 与Bickel的价值导向型理论不同，Ely的规范性的司法裁判理论在对司法裁判界定的同时就是在为法院所发挥的功效、扮演的角色进行界定。 Ely将法院比作求球场的裁判，裁判并不参与比赛的直接结果的判断，只是在比赛的过程中对程序进行裁判。法院所应该扮演的角色并不应该是结果性的，而是程序性导向性的。 Ely从1938年的“卡罗琳产品案”著名的第四注脚中产生了灵感。通过截取第四注脚的后两点并在此基础上进行进一步阐释，就构成了Ely所认为的司法审查可以进行的程序意义上的干涉的两种情况。一是在政治程序可能受到破坏的情况下，二是在少数人受到不公正待遇的时候。这两种情况，在Ely看来，恰好符合了沃伦法院所广泛关注的两个层面。一方面是疏通政治变革的渠道，另一方面是纠正对少数人的歧视。如果Ely的司法审查理论能成立，那么沃伦法院的很多有争议的判决的正当性都会得到证明。 疏通政治变革的道路与少数人的权利保护，这两项最高法院所应有的职能，旨在保护代议制程序的公正性，而非是确保程序结果与政策选择的正确性。所以，法院本身依据这种原理并不会威胁代议政治，反而会补充与强化代议制民主程序，进而从规范的角度回答了“反多数主义”的问题。...
